Terms of Service

These Terms of Service govern your use of BigStats, operated by BigStats.email, 507 Ft. Pena, San Antonio, TX 78245 USA. By creating a workspace or using the service you agree to them. If you are agreeing on behalf of an organisation, you confirm you have authority to bind it.

BigStats ingests event notifications from mail transfer agents you operate or control and produces delivery reports, exports and alerts. BigStats reads only; it does not send your mail, alter routing, or modify message content.

• Sign-in is passwordless. You are responsible for the security of the mailbox you sign in with.
• Ingest keys and API tokens are secrets. Keep them confidential and rotate them if exposed.
• You are responsible for the actions of users you invite to your workspace.

• You retain all rights in the data you send to BigStats. You grant us the limited licence needed to host, process and display it to your workspace, and to operate and secure the service.
• You confirm you have the legal right and any required consents to send that data to us, and that your sending complies with applicable law including CAN-SPAM, GDPR and similar rules.
• You may not use BigStats to support unlawful, deceptive or unsolicited bulk email, or to process special categories of personal data without appropriate safeguards.

Do not attempt to breach or probe the service's security, access another customer's workspace, reverse engineer the service, resell it without authorisation, or place load on the ingest or API endpoints that degrades service for others. We may apply reasonable rate limits.

Paid plans are billed in advance per the plan you select and are non-refundable except where required by law. We will give notice before any price change takes effect on your next renewal.

We work to keep BigStats available and continuously ingesting, but the service is provided without an uptime commitment unless a separate written service level agreement is in place. Support is available at hello@bigstats.email.

Our Privacy Policy explains how we handle personal data. Where we process personal data on your behalf, the Data Processing Agreement applies and is incorporated into these Terms.

BigStats, its software, interfaces and documentation remain our property. Feedback you provide may be used to improve the service without obligation to you.

Except as expressly stated, the service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, neither party is liable for indirect, incidental or consequential damages or lost profits, and our total liability for any claim is limited to the fees you paid us in the twelve months before the claim arose.

You may close your workspace at any time. We may suspend or terminate access for material breach of these Terms, non-payment, or activity that threatens the security or integrity of the service, with notice where practicable. On termination, data is deleted or returned as described in the DPA.

We may update these Terms and will post the revised version here with a new date; continued use after the change constitutes acceptance. These Terms are governed by the laws of the State of Texas, USA, and the state and federal courts located in Bexar County, Texas have exclusive jurisdiction.
